Terms of Use

By accessing or using JoziFX (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

JoziFX is an educational coaching and analytics platform for traders. All output produced by the Service — whether generated by the in-app Coach, by human-curated content, or by Artificial Intelligence (AI) — is provided strictly as analysis, commentary, and educational material. It is never advice, never a recommendation, and never a solicitation to buy, sell, or hold any financial instrument.

You are solely responsible for evaluating any analysis, signal, level, plan, or commentary produced by the Coach before acting on it. You acknowledge that markets are volatile, that past performance does not guarantee future results, and that all trading decisions, executions, position sizing, gains, and losses are yours alone.

You confirm that you have the experience, knowledge, and financial means to assess the merits and risks of any trading activity and that you have, where appropriate, sought independent professional advice.

Nothing on or produced by the Service constitutes financial, investment, tax, legal, or accounting advice. JoziFX is not a registered broker, dealer, investment adviser, financial planner, or tax adviser in any jurisdiction. Do not treat any Coach output as a recommendation.

Your use of the Service does not create a fiduciary, advisory, agency, partnership, joint venture, or employment relationship between you and JoziFX.

Parts of the Service use Artificial Intelligence (AI) models to generate analysis, summaries, critiques, and other content. AI output may be incomplete, outdated, biased, factually wrong, or otherwise unreliable. You must independently verify any AI-generated material before relying on it. JoziFX does not guarantee the accuracy, completeness, timeliness, or suitability of any AI-generated content for any purpose.

You must be at least 18 years old to use the Service. You are responsible for keeping your credentials confidential and for all activity under your account. Subscription fees, trial periods, renewal, and cancellation are governed by the plan you select at sign-up. You may cancel at any time from the Billing area.

You agree not to (a) abuse, overload, or attempt to gain unauthorised access to the Service or any AI model behind it; (b) scrape or harvest data; (c) reverse engineer or attempt to derive source code; (d) use the Service to violate any law or third-party right; or (e) impersonate any person.

All content, software, branding, designs, and models offered through the Service are owned by JoziFX or its licensors and are protected by intellectual-property laws. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal trading education.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless JoziFX, its owners, directors, officers, shareholders, employees, contractors, consultants, agents, affiliates, partners, suppliers, and licensors (the "Indemnified Parties") from and against any and all claims, demands, losses, damages, liabilities, costs, fines, penalties, and expenses (including reasonable legal fees) arising out of or related to:

• (a) your access to or use of the Service;
• (b) any trade, position, order, or financial decision you place, fail to place, or modify;
• (c) any reliance on Coach, AI, or other Service output;
• (d) any breach by you of these Terms;
• (e) your violation of any law or regulation;
• (f) any claim brought by a third party arising from your use of the Service;
• (g) any loss of funds, profits, or opportunity, however caused.

You acknowledge that the Indemnified Parties have no responsibility for any unintended outcome, error, omission, downtime, data loss, market dislocation, slippage, broker failure, or mishap connected with your use of the Service.

To the maximum extent permitted by law, the aggregate liability of the Indemnified Parties for any and all claims arising out of or relating to the Service shall not exceed the fees you actually paid to JoziFX in the three (3) months preceding the event giving rise to the claim. The Indemnified Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading opportunity.

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any reason we deem appropriate. You may stop using the Service and delete your account at any time from Settings.

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the competent courts of Gauteng, South Africa.

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the new Terms. Material changes will be communicated in-app or by email.
